1. Acceptance of Terms
By using DMEBuyAndSell, you agree to these Terms & Conditions, our Privacy Policy, and any additional policies posted on the platform. These terms apply to all users — visitors, buyers, sellers, and registered users.
2. Use of Services
You must be at least 18 years old to use our services. You are responsible for maintaining account confidentiality and all activity under your account. You agree to comply with all applicable laws including federal healthcare regulations and Florida state laws governing medical equipment resale. Prohibited activities include: posting false or misleading listings, selling recalled/expired/counterfeit equipment, listing restricted devices without authorization, or violating healthcare or consumer protection laws.
3. Durable Medical Equipment (DME) Compliance
DMEBuyAndSell is a marketplace platform only and does not inspect, certify, or guarantee any listed equipment. Buyers are responsible for verifying proper fit, intended use, FDA and Florida law compliance, and not using damaged, recalled, or unsafe equipment. Sellers must only list items legally eligible for resale, properly sanitized, and accurately described, disclosing all known defects or repairs. Prescription-only devices and life-support/implantable equipment must not be listed without proper authorization.
4. Florida-Specific DME Resale Compliance
Used equipment must be properly cleaned, disinfected, and safe for reuse. Certain devices require a valid prescription under Florida law. Businesses engaged in frequent commercial resale may require Florida health care licensing. Prohibited items: recalled/FDA-restricted devices, expired or unsafe equipment, life-support or critical-use devices (unless legally permitted), and any equipment prohibited under Florida or federal law. DMEBuyAndSell does not verify compliance — users assume full responsibility.
5. No Medical Advice
DMEBuyAndSell does not provide medical advice. All content is informational only. Always consult a licensed healthcare provider before purchasing or using any medical equipment.
6. Transactions
DMEBuyAndSell is a neutral marketplace platform and is not a party to any transaction between buyers and sellers. Payments are processed via third-party providers — we do not store payment details. Buyers and sellers must resolve all disputes directly. DMEBuyAndSell is not responsible for mediation.
7. Account Termination
We may suspend or terminate accounts without notice if terms are violated or if your activity poses a risk to other users or to the platform.
8. Disclaimers & Limitation of Liability
Services are provided "as is" and "as available." DMEBuyAndSell is not liable for injury or harm resulting from equipment use, improper setup or misuse, regulatory non-compliance by users, or any indirect, incidental, or consequential damages.
9. Indemnification
You agree to indemnify and hold harmless DMEBuyAndSell, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising from your use of the platform, the sale or use of medical equipment, or violation of laws or these Terms.
10. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
11. Changes to Terms
We may update these Terms at any time. Updates will be posted on this page with a revised effective date. Continued use of the platform constitutes acceptance of any updates.
12. Third-Party Login
If you use a third-party login (e.g., Google or Facebook), we receive limited profile data as permitted by you. We do not store your third-party password. The third-party service governs its own data policies. You may disconnect your account at any time through your account settings.
